The meeting room was packed for the April 13th New Hanover Township Board of Supervisors meeting; in fact, 15-20 residents were expected to stand for the entire 2-hour meeting. A few left rather than stand, since no extra folding chairs were provided.

Even though the board chairman announced that the quarry would not be on the agenda, as required the township allowed questions from the floor. Many residents, for the third time in one month, insisted that the shameful “stipulation agreement” be rejected by the Board.

Township solicitor, Paul Bauer, again explained the mistakes made in codifying the ordinances under challenge by Gibraltar Rock’s lawyer. Many residents are insisting that the township go to court and fight for us, but Mr. Bauer reiterated that he does not believe the township will be successful in a court battle. The township continues to insist that if they lose in court, we would be stuck with an unregulated quarry. We believe that to be a false assumption.

OK - so the township and their legal advisors do not believe they can win in court? Let’s suppose the township actually does believe that we would be stuck with an unregulated quarry. Obviously, that wouldn’t bother the Board of Supervisors – because with this anemic stipulation agreement, WE WILL HAVE AN UNREGULATED QUARRY!

As the attorney for Ban-the-Quarry, Christopher Mullaney, stated at a March meeting – if the township goes to court and loses, what the township is left with couldn’t be any worse than this agreement!

At the March 30 meeting, most of us thought the board chairman announced we would have two weeks’ notice before a vote is announced. At the April 13th meeting, he only promised one week’s notice.
