On Thursday, May 28, 2009, we traveled to Norristown for a hearing on our “petition to intervene” in the appeal that is pending in that court, which is Gibraltar Rock, Inc. vs. New Hanover Township Zoning Hearing Board. Gibraltar Rock filed the appeal in the Fall of 2007 following the zoning board’s decision on quarry Application #1 (or GR1). Our three witnesses presented persuasive and valuable testimony. Uday Patankar testified for Gibraltar Rock. Steve Harris (Gibraltar’s attorney) asked our witnesses if they are aware the township refused to vote “yes” for the stipulation agreement. This was a “trick question”, since our Board of Supervisors did not vote ‘yes’ or ‘no’ on the proposed agreement. Oral arguments are scheduled for June 30. The judge’s decision will follow the June 30th court date. If the court rules in our favor, there won’t be any more unknown (to us) negotiations/settlement agreements between Gibraltar Rock and our township. When we are notified of a decision, we will post on this website. |
