Summary of November 15, 2007 Zoning Hearing Board Meeting |

Note: The following is not a verbatim transcript of the Zoning Hearing Board meeting; it is simply one person’s summary of the major points made by those involved in the hearing process. Note: In GR2, Mr. Stephen Harris, attorney for
Gibraltar Rock is introducing witnesses who have already testified in GR1.
He is basically introducing their GR1 testimony into GR2 and allowing
the opposing attorneys to cross examine the witness on their previous
testimony. This is in an
attempt to speed up the hearings. Michael Madalavich, CFO, Silva Group was the witness. Mr. Harris, attorney for the Silva Group, asked him questions on his economic analysis of a viable quarry in New Hanover Township. Madalavich was the person who provided Mr. Alan K. Stagg, the economic geologist who (back in 2002 and 2003) provided evidence on the economics of quarrying. For more information, see the beginning of Stagg’s testimony Mr. Lawrence Sager cross-examined Madalavich, but was unable to obtain any useful information. The township’s attorney had no questions. Mr. Edward Skypala, attorney for the zoning hearing board, had the most pointed questions for Madalavich. While trying to determine when Madalavich had discussed economics with Stagg, how much he provided Stagg, and what physical documentation (letters, email, etc) was available, Madalavich used the Alberto Gonzales defense by saying that he didn’t quite remember when he met with Stagg or if he provided Stagg with certain information. Smooth. After this Harris closed the evidence presentation portion of his case. As of January 24, 2008 Sager will begin his case against the quarry. The township’s attorney was unable to say whether or not the township would present additional witnesses against the quarry, other than those presented in GR1. The next GR2 is scheduled for Thursday January 24, 2007. |
