Summary of February 16, 2004 Zoning Hearing Board Meeting |

Note: The following is not a verbatim transcript of the Zoning Hearing Board meeting; it is simply one person’s summary of the major points made by those involved in the hearing process. Mr. Stephen Harris,
attorney for Gibraltar Rock began by introducing Mr. Alan K. Stagg to GR2.
As many of you know, Stagg was offered as an expert witness on
“Economic Geology” in GR1. Harris
placed into GR2 all of Stagg’s testimony from GR1 including his testimony
from Oct. 2002, December
2002, January 2003, March
2003. Mr. Lawrence Sager,
(representing Louis Farrell of Atomic International) began his
cross-examination of Stagg. Sager
got Stagg to admit that Stagg did not review the mining application but only
reviewed the mining plan. Sager
kept trying to get him to correlate the zoning ordinance with economic
viability. It appeared that he (Stagg) only reviewed some of the planning
information and did not review external cases for mines with 100T-400T
tons/year. After about an hour, Sager
had no more questions. Mr. Bob Brant, township attorney had none either. Harris asked Stagg a few
questions to clarify his earlier statements and Sager objected to the fact
that Stagg did not do any analysis of the economic viability of different
size quarries. Unbelievably, the meeting ended early and the meeting for the next night, Feb 17th was cancelled. The next GR 2 meeting is April 20, 2005 at the New Hanover Township Building, 7:00 PM. |
