Gibraltar 1 Summary of May 15, 2003 Zoning Hearing Board Meeting |

Note: The following is not a verbatim transcript of the Zoning Hearing Board meeting; it is simply one person’s summary of the major points made by those involved in the hearing process. For that reason, quotation marks are not used unless a direct quote was recorded. For information about obtaining an official ZHB transcript, contact the New Hanover Township office. The meeting began with Mr. Stephen Harris, Gibraltar rock attorney having Mr. Ken Amey, Land Planner and hired zoning consultant enter into exhibit a chart that compared the townships changes to zoning ordinances from 1990-2002. This chart was designed to show pre-code changes, code, and post-code changes---its intent (while Amey never verbalized it) was to show that the township purposely changed the code to make it impossible to have a quarry. One of the zoning board members asked Amey if the removed information was still in a summary table, Amey said they were. He then asked if it was his (Amey's) feeling that the information was removed because it would not be allowed. Amey said "yes." The board member then said that it was up for interpretation that what was done was intentional instead of a typographical error. Amey responded that his conclusion is that it was intentional. The board member said that all seven items that had been removed were still in the table. Amey said that, in his opinion, the error was in not amending the table. With the end of this testimony, Mr. Harris ended his case. Note: This is a big turning point. After two years of testimony and witnesses, the GRI case is closed. Beginning next month Mr. Bob Brant, attorney for the township will begin his case by presenting Hank Clemmer, former zoning officer for New Hanover Township.
