Another Win For New Hanover Township And Ban The Quarry

 
 

On February 9, 2011, Judge William J. Furber, Jr, of the Montgomery County Court of Common Pleas, Norristown, PA, rendered his decision following oral arguments before him on December 3, 2010. 

The proposed quarry, Gibraltar Rock, Inc, asked the Court to overrule our Zoning Hearing Board’s decision to dismiss Gibraltar Rock’s Application #3 submitted to the township in 2007.  This application planned a quarry operation on over 300 acres – the entire acreage owned by the Silvi Group of Fairless Hills, Bucks County, PA.

Judge Furber has upheld the Zoning Board’s decision in response to Ban-the-Quarry’s position that the third application should never have been filed by the company.  The Court has now affirmed the dismissal of this application (referred to as GR-3).

At the 12-3-10 hearing in Norristown, the leading argument was presented by our attorney, Thomas M. Keenan, Esq, of Collegeville.  Presenting argument for the Township was Attorney Ed Skypala, Pottstown.  Attorney Lawrence Sager, representing Louis Farrell, president of Atomic Intl, New Hanover Township, spoke on behalf of his client and in support of our position and that of the Zoning Hearing Board.
