Update:, January 22, 2010  -  Court of Common Pleas, Norristown, PA -New Hanover Township vs. Gibraltar Rock, Inc.

 
 

In early September, 2009, New Hanover Township filed a Petition for Preliminary Injunction with the Montgomery County Court of Common Pleas.  There was a hearing scheduled for October 5 that was subsequently rescheduled and held on November 6, 2009.

Following the November 6th hearing, the township’s special counsel was required to file a brief by December 7; Gibraltar Rock’s attorney was required to file a brief by January 8.  The date of January 22,  2010 was set by the court for “oral arguments” before Judge Kent Albright, unless a settlement was reached by the parties before the January 22nd date.  A settlement was not reached.

Ban-the-Quarry was present at the Jan 22nd hearing as Judge Albright heard the attorneys’ final arguments.  Our attorney, Tom Keenan, filed a brief is support of the township’s injunction.  On Jan 22nd, Judge Albright gave the township and Gibraltar Rock, Inc. another two weeks to file an additional brief.  It appears that the decision on the Preliminary Injunction will be announced sometime in February, 2010.
