Update:  Our Efforts to “Ban the Quarry”

 
 

On November 1, 2010, we received “Notice of Discontinuance of Action” from the Commonwealth Court of Pennsylvania in Harrisburg.  On August 3, 2010, New Hanover Township and the Paradise Watchdogs received a favorable decision from the Montgomery County Court of Common Pleas.  The Honorable Calvin Drayer dismissed Gibraltar Rock’s “Motion for Preemptory Judgment”.  This action by the quarry concerned the GR-3 Application and their desire to conduct mining on residential and agricultural land bordered by Church Road, Colflesh Road, and Houseman Road. 

At the hearing on August 2, Ban-the-Quarry’s attorney, Thomas Keenan, presented a brief to Judge Drayer in support of the Zoning Hearing Board’s dismissal of the GR-3 Application based on the belief that Gibraltar Rock should never have filed Application 3.  Following Judge Drayer’s decision, Gibraltar Rock filed an appeal with Commonwealth Court.  We are pleased to report that Gibraltar Rock withdrew their appeal on November 1, 2010.
